Terms and Conditions

Please read these terms carefully before completing your purchase. They include a waiver of liability and assumption of risk that affect your legal rights. By checking the box at checkout, you confirm that you have read, understood, and agreed to all of the terms below.

1. Proper Use and Responsibility

Saberfiit products and programs are designed for a specific intended purpose. You agree to use any product, training tool, or program only as instructed and only for its intended purpose. You are responsible for your own conduct and safety, and for the safety of anyone you choose to train with. If you train with another person, you accept the risks that come with shared physical activity.

2. Assumption of Risk

Physical training with Saberfiit products carries inherent risks, including but not limited to: muscle strain and overexertion, impact from strikes or swings, injury from dropped, thrown, or mishandled equipment, collision or contact with a training partner, and slips or falls. You acknowledge that you understand these risks, that you participate voluntarily, and that you have inspected any equipment and judged it safe for your use. You accept full responsibility for your own health and fitness, and you agree to consult a physician before beginning any new physical training.

3. Release of Liability and Indemnification

To the fullest extent permitted by law, you release and waive any claim against Saberfiit, and its owners, officers, employees, contractors, instructors, and affiliates, from any liability for injury, loss, or damage arising from your use of any Saberfiit product or program, including liability arising from ordinary negligence. You agree to indemnify and hold harmless the parties named above from any claim brought by you or by any third party arising from your use of a Saberfiit product or program, including claims connected to training with others. This release does not apply to gross negligence, recklessness, or intentional misconduct, and nothing in these terms removes any right that cannot be waived under applicable law.

4. Use by Minors

Saberfiit products are intended for use by adults. If you purchase a product for use by a minor, or allow a minor to use a product, you do so as the responsible parent or legal guardian, you agree to supervise that use, and you accept the risks described above on the minor’s behalf, to the fullest extent permitted by law.

5. In-Person Training

These terms apply to your purchase and use of Saberfiit products and programs. Any in-person or instructor-led training is governed by a separate waiver that you will be asked to sign before participating. Nothing in these terms replaces or limits that separate waiver.

6. Digital Files and 3D Print Designs

Digital files, including 3D print designs, are licensed to you for personal, non-commercial use only. You may print and use these files for yourself. You may not resell, redistribute, share, gift, sublicense, or commercially exploit the files, any modified or derivative version of them, or any physical item produced from them. All intellectual property rights in the files remain with Saberfiit. Any breach of this section immediately terminates your licence to use the files.

7. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute arising from these terms or your purchase will be subject to the exclusive jurisdiction of the courts of Ontario.

8. Severability

If any provision of these terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

9. Acknowledgment

By checking the box at checkout, you confirm that you have read and understood these terms, that you had the opportunity to ask questions, that you are agreeing freely, and that you are bound by them.
